To establish a solid foundation for our working relationship and address potential concerns, we kindly request that you carefully review the following Terms and Conditions (“Agreement”). By engaging with our services, you agree to be bound by these terms and conditions.

 

Services Offered:

360Brandings offers a comprehensive suite of digital marketing services, tailored to meet your specific business needs. Our services encompass cutting-edge website design, strategic search engine optimization (SEO), engaging social media marketing, compelling content creation, and results-driven online advertising campaigns.

 

Client Satisfaction Guarantee:

Your satisfaction is of utmost importance to us. We are committed to delivering high-quality services that align with your goals and expectations. Throughout our engagement, we encourage open and transparent communication. If, at any point, you have concerns or are dissatisfied with any aspect of our services, we are here to listen and work with you to find a satisfactory solution.

 

Results and Performance:

While we employ proven strategies and industry best practices, it is important to note that the success of digital marketing campaigns can be influenced by various external factors beyond our control. These factors include market dynamics, industry competition, and evolving customer preferences. Therefore, we cannot guarantee specific outcomes, revenue generation, or performance guarantees. We strive to maximize the effectiveness of our efforts, but the results achieved may vary.

 

Payment and Refunds:

 

In any event, any deposited funds for a project shall not be subject to refund after delivery if the initial digital marketing deliverables are approved, or a change is requested unless 360Brandings cancels or terminates your Contract for a reason other than your breach or non-performance.

 

ALL REFUND REQUESTS WILL BE FULFILLED AS PER THE FOLLOWING ARRANGEMENT:



  • A refund request will need to have a valid reason which must be qualified against the marketing brief and customer feedback for revisions. Unless a concept has not been developed according to the brief, a refund will not be given, however further revisions will be provided until complete satisfaction.
  • All refund requests should be communicated to the account manager, project manager, or support department. 360Brandings, based on the violation of your user agreement, reserves the right to approve/disapprove your request on an individual case-to-case basis.
  • All digital marketing campaigns require customer feedback before finalizing the strategy; therefore, it is only fair that the customer gets involved and provides feedback to achieve the desired results.
  • For websites, mobile apps, and game projects, no refund will be entertained once website development has been completed or once the website has been deployed live.
  • For video animation projects, no refund request will be entertained after the creation of the storyboard.
  • If a request for a refund is made before the delivery of initial digital marketing concepts, then you would be eligible for a Full Refund (less 10% service & processing fee).
  • If a request for a refund is made within 48 hours, you would be eligible for a 66% refund (less 10% service & processing fee).
  • If a request for a refund is made between 48-120 hours of the initial strategy delivery, you would be eligible for a 33% refund (less 10% service & processing fee).
  • If the company’s policies, or policy, have not been violated.
  • If the creative brief is lacking required information.
  • If the claim hasn’t crossed the given ‘request for refund’ time span.
  • If another company or marketer hasn’t been approached for the same project.
  • If the business is closing, changing the name, or ceasing operations due to reasons related to our company. Refund will not be approved for reasons unrelated to our company.
  • If a client subscribes to a service bundle and happens to be dissatisfied with a particular service, a refund will only be applicable to that particular service and ‘not’ the entire bundle.
  • If the refund has been processed, the customer or the entity will have zero authority to use any source of work or marketing material that has been shared with the client. If found, it will be a breach of contract, and legal proceedings will be initiated.
  • Money back guarantee is based on the order being placed in good faith. Where a customer has placed marketing orders with more than one marketing agency for the same job with the intention to claim a refund, we do not consider it a good faith. In such a case, we reserve the right to decline a refund request.
  • No refund will be approved on any special package/offer.
  • No refund will be approved if revisions have been demanded.
  • No refund will be approved for reasons such as ‘change of mind,’ ‘disagreement with partner,’ or other reasons that do not pertain to the service and are not subject to refund under any circumstances.
  • No refund will be approved for services like Social Media, SEO, Domain Registration, and Web Hosting under any circumstances.
  • No refund request will be entertained if you have not taken any action on your order for 30 days after placing it. However, if you want to reactivate your marketing order, you will be charged a certain fee depending on your project.




Intellectual Property:

All intellectual property rights associated with the services provided by 360Brandings, including copyrights, trademarks, and trade secrets, remain the exclusive property of our company. Unless explicitly authorized in writing by us, you may not use, reproduce, modify, or distribute any proprietary information.

 

Confidentiality:

We understand the importance of safeguarding your sensitive business information. Both parties agree to maintain the strictest confidentiality regarding any proprietary or confidential information exchanged during our engagement. This includes, but is not limited to, business plans, customer lists, trade secrets, and any other information marked as confidential. Our commitment to confidentiality extends beyond the termination of this Agreement.

 

Limitation of Liability:

While we strive to provide exemplary services, we acknowledge that unforeseen circumstances and factors beyond our control may arise. Therefore, to the maximum extent permitted by applicable law, 360Brandings shall not be held liable for any direct, indirect, incidental, consequential, or exemplary damages. This includes, but is not limited to, loss of profits, data, or business opportunities, arising from the use or inability to use our services, even if we have been advised of the possibility of such damages.



Modification of Terms:

360Brandings reserves the right to modify or amend these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website or providing notice to you. We encourage you to review these terms periodically for updates.
